Direction of the Info-communications Development Authority of Singapore - Amendments to Reference Interconnection Offer ("RIO")
For the purposes of giving effect to IDA's decision dated 12 April 2006 on SingTel's Reconsideration Request of 20 March 2006, as varied by the Minister's decision dated 25 January 2007 upon SingTel's appeal, IDA has directed SingTel to submit  its proposed modifications to the RIO for IDA's approval. Minister's Decision on SingTel's Appeal Against IDA's 12 April 2006 Decision
The Minister of Information, Communications and the Arts ("Minister"), has, on 25 January 2007, issued his decision on SingTel's 24 April 2006 Appeal against IDA's 12 April 2006 Decision on SingTel's Reconsideration Request dated 20 March 2006 regarding Requesting Licensees' ("RLs") use of Unbundled Network Elements ("UNE"), Mandated Wholesale Services ("MWS") and Unbundled Network Services ("UNS") as inputs to telecommunications services.  The Minister's Decision is as follows:

  1. RLs may acquire UNE and MWS as inputs to the provision of any telecom product or service and supplying that telecom product or service to their affiliates so long as the intention of the RL concerned is to offer the same type of telecom product or service to non-affiliated third party customers;

  2. RLs may acquire UNS as inputs for the provision of a telecom product or service and supplying that telecom product or service to themselves and/or their affiliates so long as the intention of the RL concerned is to offer the same type of telecom product or service to non-affiliated third party customers.

  3. Clause 1.1 of the relevant Schedules shall be amended as set out below, to incorporate the above and to include affiliates of RLs within the definition of “Customer”:

    “This Schedule [relevant input] sets out the terms and conditions under which SingTel will provide the Requesting Licensee with […]. Notwithstanding anything in this Schedule, the Requesting Licensee may:

    1. use the [relevant input] as an input for the provision of any telecommunication product or service for its private internal use, and/or

    2. acquire the [relevant input] as inputs to the provision of any telecommunication product or service to its affiliates,

where the Requesting Licensee offers or intends to offer that kind of telecommunication product or service (whether or not using the same [relevant input]) to non-affiliated third party [Customers/End Users]. For this purpose, any reference in this Schedule to the term [Customer/End User] shall, where appropriate, also refer to the Requesting Licensee or its affiliates.

For the avoidance of doubt, SingTel is not required to provide the Requesting Licensee with a licence to use [relevant input] for the provision of any telecommunication product or service to itself [the Requesting Licensee] if the Requesting Licensee does not intend to offer that kind of telecommunications product or service to non-affiliated third party customers.”

Minister's Decision on SingTel's Appeal on IDA's  8 August 2005 Decision on  Reconsideration
The Minister for Information, Communications and the Arts ("Minister") has, on 9 February 2006, issued his decision on SingTel's 22 August 2005 Appeal against IDA's 8 August 2005 Decision on Reconsideration.

The Minister's decision was as follows:

a. SingTel should comply with IDA's Decision on Reconsideration except for the following variations:

SingTel is not required to provide Requesting Licensees ("RLs") with the relevant Unbundled Network Elements ("UNE") or Mandated Wholesale Services ("MWS") when these are used as inputs to a telecommunications ("telecom") product or service for the RL's private internal use where the RL has no intention of offering that telecom product or service to non-affiliated third party customers.

In relation to the RL's acquisition of Local Loops/Sub Loops, Line Sharing and Internal Wiring as inputs to a telecom product or service for the RL's private internal use, clauses 1.1 and 1.2 of Schedules 3A, 3B and 3C of the RIO are to be amended to give effect to (i);

b. In respect of the provision of Tail Local Leased Circuits ("LLCs") and Full LLCs for the RL's own private internal use, SingTel's appeal against the IDA's Decision on Reconsideration pertaining to clauses 1.1 and 1.2 of Schedules 7A and 7B of the RIO is rejected as these clauses were not raised in SingTel's Reconsideration Request of 17 June 2005 to IDA. However, IDA may wish to review clauses 1.1 and 1.2 of Schedules 7A and 7B of the RIO to ensure their consistency with the Minister's decision in (i) and (ii).

SingTel's Appeal on IDA's Decision on SingTel's Reconsideration Request

On 22 August 2005, SingTel submitted an appeal to the Minister for Information, Communications and the Arts against IDA's 8 August 2005 Decision on SingTel's Reconsideration Request in respect of the following issues:

the provision of Local Loops/Sub Loops, Line Sharing, Internal Wiring, access to Lead-in Ducts and associated Lead-in Manholes, Tail Local Leased Circuits and Full Local Leased Circuits for the Requesting Licensee's own private use; and

the provision of Roof Space for the purposes of accessing Tail Local Leased Circuits.
Please note that in light of the appeal to the Minister, IDA has granted a partial stay of its Decision on SingTel's Reconsideration Request in respect of the issues on appeal.  As such, SingTel will still be required to submit a conformed version of its RIO but may exclude any revision to its RIO arising from the issues on appeal. SingTel has asked for an extension to submit a conformed version of its RIO. IDA granted SingTel a 1-week extension to 5 September 2005.

IDA has issued its Decision on SingTel's Reconsideration Request of 17 June 2005. The full text of the Decision can be found below. In arriving at the Decision, IDA carefully considered SingTel's Reconsideration Request, taking into account the comments of all interested parties, the requirements of the Telecom Competition Code 2005 and IDA's policy principles underpinning the Telecom Competition Code 2005. IDA has also lifted the Stay of the Direction granted to SingTel in a letter dated 21 June 2005. Accordingly, SingTel must

21 June 2005 Request by SingTel for Reconsideration of IDA's Direction dated 3 June 2005 in Relation to SingTel's RIO

On 3 June 2005, following IDA's review of SingTel's proposed revised RIO, including the comments received from various respondents on the public consultation of SingTel's proposed revised RIO, IDA issued a direction to SingTel ("Direction"), requiring modifications to the proposed revised RIO to ensure that the RIO remains relevant and complies with the requirements of the Telecom Competition Code 2005 ("Code 2005"). , pursuant to section 69(1) of the Telecommunications Act (Chapter 323) ("Act") and sub-section 11.9.1(a)(i) of the Code 2005, SingTel submitted its request to IDA to reconsider the Direction ("Reconsideration Request"). In addition, pursuant to sub-section 11.9.4 of the Code 2005, SingTel requested for a stay of the Direction. Pursuant to sub-section 11.9.2 (b) of the Code 2005, IDA is hereby providing interested parties with an opportunity to file comments on the Reconsideration Request. In this regard, all views and comments on the Reconsideration Request must be submitted in writing to IDA
